- Services to be Provided
Photographer, David Saravia, agrees to provide photography services to Client for the purpose of capturing high-quality images, in the city of Paris, France, as specified in the Client’s order on the parisphotodavid.com website. The Photographer shall have full artistic control over the photographs, including the selection of images and any necessary editing. Photographer agrees to provide the images to Client within a reasonable time after the photo shoot, as specified on the parisphotodavid.com website.
- Payment
Client agrees to pay at least 50% of the amount for the photography services ordered on the parisphotodavid.com website. Payment shall be made through the payment portal on the parisphotodavid.com website at the time of booking. The rest shall be payed at the end of the shooting with credit card, PayPal or cash.
- Rescheduling/Cancellation Policy
Client may reschedule or cancel the photo shoot for any reason up to 48 hours before the scheduled date and time. If Client cancels or reschedules within 48 hours of the scheduled date and time, Client shall forfeit the deposit paid at the time of booking.
- Copyright and Usage
Photographer, David Saravia, retains the copyright and ownership of all images taken during the photo shoot. Photographer grants Client a non-exclusive, non-transferable, perpetual license to use the images for personal or commercial use, including but not limited to reproduction, display, and distribution in print or digital formats. Client agrees not to sell or transfer the images to any third party without the express written consent of Photographer.
- Liability and Limitation of Liability
Photographer, David Saravia, shall not be liable for any loss or damage to Client’s property during the photo shoot. Photographer shall not be liable for any consequential or incidental damages arising from the performance of this Agreement. In any event, Photographer’s total liability shall not exceed the total amount paid by Client to Photographer for the photography services.
- Dispute Resolution and Governing Law
This Agreement shall be governed by and construed in accordance with the laws of France. Any disputes arising out of or relating to this Agreement shall be resolved through binding arbitration in accordance with the rules of the French Arbitration Association.
- Entire Agreement and Amendment
This Agreement constitutes the entire understanding between the parties and supersedes all prior negotiations, understandings, and agreements between the parties. This Agreement may be amended or modified only in writing signed by both parties.
Client acknowledges that he/she has read and understands this Agreement and agrees to be bound by its terms and conditions. This Agreement shall be binding upon and inure to the benefit of the parties hereto and their respective successors and assigns.
- Services à fournir
Le photographe, David Saravia, accepte de fournir des services de photographie au client dans le but de capturer des images de haute qualité, dans la ville de Paris, France, telles que spécifiées dans la commande du client sur le site parisphotodavid.com. Le Photographe aura un contrôle artistique complet sur les photographies, y compris la sélection des images et toute édition nécessaire. Le Photographe s’engage à fournir les images au Client dans un délai raisonnable après la séance photo, tel que spécifié sur le site parisphotodavid.com
- Paiement
Le Client accepte de payer au moins 50% du montant des services de photographie commandés sur le site parisphotodavid.com. Le paiement sera effectué via le portail de paiement sur le site parisphotodavid.com au moment de la réservation. Le reste du paiement sera effectué à la fin de la séance photo par Carte bleu, PayPal ou en espece.
- Politique de report/annulation
Le client peut reporter ou annuler la séance photo pour quelque raison que ce soit jusqu’à 48 heures avant la date et l’heure prévues. Si le client annule ou reporte dans les 48 heures précédant la date et l’heure prévues, le Client perd son dépôt versé au moment de la réservation.
- Droits d’auteur et utilisation
Le Photographe, David Saravia, conserve le droit d’auteur et la propriété de toutes les images prises pendant la séance photo. Le Photographe accorde au Client une licence non exclusive, non transférable et perpétuelle pour utiliser les images à des fins personnelles ou commerciales, y compris, mais sans s’y limiter, la reproduction, l’affichage et la distribution sous forme imprimée ou numérique. Le Client s’engage à ne pas vendre ou transférer les images à un tiers sans le consentement écrit préalable du Photographe.
- Responsabilité et limitation de responsabilité
Le Photographe, David Saravia, ne sera pas responsable de toute perte ou dommage aux biens du Client pendant la séance photo. Le Photographe ne sera pas responsable de tout dommage indirect ou accessoire découlant de l’exécution de cet Accord. En tout état de cause, la responsabilité totale du Photographe ne pourra dépasser le montant total payé par le Client au Photographe pour les services de photographie.
- Résolution des litiges et droit applicable
Cet Accord sera régi par et interprété conformément aux lois de la France. Tout litige découlant de ou lié à cet Accord sera résolu par arbitrage contraignant conformément aux règles de l’Association Française d’Arbitrage.
- Accord complet et amendement
Cet Accord constitue l’accord complet entre les parties et remplace toutes les négociations, ententes et accords antérieurs entre les parties. Cet Accord ne peut être modifié que par écrit signé par les deux parties.
Le Client reconnaît avoir lu et compris le présent Contrat et accepte d’être lié par ses termes et conditions. Le présent accord lie et s’applique au bénéfice des parties aux présentes et de leurs successeurs et ayants droits respectifs.
